Terms of Service
Effective: January 1, 2025
These Terms of Service govern the weed control services provided by GreenGuard Weed Control ("GreenGuard," "we," "our") to residential and commercial customers in the Fraser Valley, British Columbia. By scheduling or accepting service, you agree to these terms.
1. Services
GreenGuard provides selective herbicide treatments, pre-emergent applications, perimeter treatments, and related weed management services. Specific services, visit frequencies, and coverage areas are described in your service agreement or quote.
2. Service Agreement
Annual plans run for 12 months from the first treatment date. Single-visit services are complete upon delivery. We reserve the right to decline service for properties that present health, safety, or access concerns.
3. Your Responsibilities
- Provide accurate contact and property information at booking
- Ensure pets, children, and persons with chemical sensitivities are kept away from treated areas for the re-entry period stated on your service card
- Notify us of any food-producing plants, water features, or on-site chemical sensitivities before the first visit
- Provide reasonable access to the treatment area on scheduled service days
4. Payment
Payment is due at time of service unless otherwise agreed in writing. Annual plans may be paid in full or per visit. Overdue accounts may incur a 2% monthly interest charge after 30 days. We accept credit card, e-transfer, and cheque.
5. Cancellation and Rescheduling
You may cancel or reschedule a visit with at least 48 hours notice at no charge. Same-day cancellations after a technician has departed may incur a $25 trip fee. Annual plan cancellations after the first treatment will be prorated to completed visits at the single-visit rate.
6. The 30-Day Guarantee
If treated weeds are not visibly dead or dying within 30 days of a treatment, we will re-treat the affected area at no charge. This guarantee applies to standard broadleaf and grassy weed species. It does not apply to:
- New weed growth from untreated seeds or neighbouring properties
- Treatments on newly seeded or sodded areas within 6 weeks of installation
- Properties where the customer has applied conflicting chemicals after our treatment
- Treatments affected by rain within 4 hours of application unless we are notified
7. Liability Limitation
GreenGuard's liability for any claim arising from services is limited to the cost of the service in question. We are not liable for indirect, consequential, or incidental damages. We carry $5M commercial general liability insurance; certificate available on request.
Applications are performed by licensed pesticide applicators in accordance with Health Canada label requirements and BC Integrated Pest Management Act regulations. GreenGuard is not responsible for pre-existing lawn damage or conditions unrelated to our treatment.
8. Herbicide Application Records
In compliance with BC pesticide regulations, we maintain application records for each visit. A summary is provided on your service card. Full records are available on written request.
9. Privacy
Collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.
10. Governing Law
These terms are governed by the laws of British Columbia and the laws of Canada applicable therein. Any disputes shall be resolved in the courts of British Columbia.
